1. Acceptance and Eligibility
These Terms of Service ("Terms") are an agreement between you and WHAT'S ON THE STAR, INC., a Delaware corporation. By accessing or using WOTS, whatsonthestar.com, the WOTS iOS app, WOTS accounts, shopping links, subscriptions, or AI Fit Pics, you agree to these Terms.
You must be old enough to use WOTS under applicable law. AI Fit Pics may involve photos of faces and bodies; making AI Fit Pics available only to users age 18 or older is flagged for legal review.
2. Accounts and Security
You are responsible for the information you provide, for keeping your account secure, and for activity under your account. WOTS may suspend or terminate access if we believe your account, uploads, purchases, or use of the service creates legal, safety, fraud, security, platform, or operational risk.
3. Permitted and Prohibited Use
You may use WOTS for personal, lawful outfit discovery, editorial browsing, saved content, shopping navigation, account features, and AI Fit Pics as allowed by these Terms.
You must not use WOTS to:
- Violate law, third-party rights, platform rules, or these Terms.
- Scrape, copy, resell, reverse engineer, overload, or interfere with WOTS.
- Upload or create unlawful, infringing, exploitative, non-consensual, defamatory, harassing, deceptive, sexual, intimate, or abusive content.
- Impersonate another person or falsely imply endorsement by WOTS, an artist, brand, retailer, photographer, or rights holder.
- Use WOTS or AI Fit Pics for fraud, misleading advertising, political deception, explicit deepfakes, harassment, or unlawful commercial content.
4. Shopping Links, Retailers, and Products
WOTS helps users discover outfits, products, brands, merchants, and shopping links. Unless explicitly stated, WOTS is not the merchant, seller, manufacturer, retailer, shipping provider, or return provider for products shown on WOTS.
Third-party purchases are governed by the merchant's own terms, policies, prices, shipping, taxes, customs, returns, refund rules, and dispute processes. WOTS does not guarantee that products are available, authentic, correctly priced, correctly identified, correctly sized, identical to images shown, or available through a particular merchant.
WOTS is not responsible for fulfillment, delivery, shipping delays, returns, customs, taxes, product quality, sizing, merchant communications, or merchant disputes.
5. iOS Subscriptions
Paid AI Fit Pics subscriptions in the WOTS iOS app are processed through Apple In-App Purchase. The price, billing period, trial terms, renewal terms, included usage, and subscription benefits are the terms displayed to you at purchase.
Subscriptions may automatically renew unless canceled through your Apple account settings before Apple's renewal deadline. Deleting your WOTS account does not automatically cancel an Apple subscription. You can restore purchases where supported by Apple and WOTS. Refund requests are handled by Apple, subject to applicable law.
WOTS may adjust product limits, usage policies, abuse controls, or feature availability where legally permitted, but WOTS must not misrepresent purchased benefits.
6. AI Fit Pics Terms
AI Fit Pics produces simulated and synthetic images. Results may be inaccurate, incomplete, distorted, inconsistent, unrealistic, or delayed. Results do not guarantee how clothing will fit, look, feel, move, or appear in real life and are not professional styling, sizing, purchasing, medical, body-image, or other professional advice.
Garment construction, logos, colors, proportions, patterns, materials, product details, brand marks, and artist outfit references may be represented incorrectly. A generated result does not mean an artist, photographer, brand, designer, retailer, merchant, or rights holder approved, endorsed, sponsored, or participated in the generation.
Generated results may be similar to existing imagery or third-party content. WOTS does not guarantee that AI outputs are copyrightable, exclusive, commercially usable, or free of third-party rights.
Your upload responsibilities
- You may upload only a photo of yourself or a person who has given valid permission.
- You must have all rights and consent needed to upload and process the photo.
- You must not upload photos of minors without valid parental or guardian authority.
- You must not upload someone else's photo to impersonate, embarrass, exploit, harass, or falsely portray that person.
- You must not create false endorsements, misleading ads, fraud, impersonation, explicit deepfakes, political deception, or unlawful commercial content.
Output rights
Subject to these Terms and applicable law, WOTS gives you a limited right to save and share your own AI Fit Pics result for personal, non-commercial use. This does not give you rights in third-party artist photos, fashion designs, trademarks, product images, logos, artist likenesses, or other underlying materials. WOTS may block, remove, refuse, or limit generations that create legal, safety, rights, platform, or abuse risk.
7. Artist Photos, Likeness, and Editorial Content
WOTS identifies clothing and documents fashion worn by artists and public figures. Artist names may be used to identify the person whose outfit is being discussed. Artist photos may be owned by photographers, agencies, publications, artists, labels, event organizers, or other third parties. Photo credits do not replace permission or another valid legal basis.
WOTS does not claim ownership of third-party photographs unless expressly stated. Images may be displayed for identification, commentary, criticism, news reporting, cataloging, or editorial context where legally permitted. No artist, estate, photographer, label, agency, or rights holder should be understood as affiliated with or endorsing WOTS unless confirmed.
Artist names, images, likenesses, signatures, stage names, and identifying attributes may be protected independently from copyright. WOTS does not grant you the right to commercially exploit an artist's identity or imply endorsement. AI results must not be presented as authentic photos of an artist or as artist-approved content.
8. Brands, Trademarks, and Product Images
Brand names, product names, logos, and trademarks belong to their respective owners. WOTS may use brand and product names for identification, description, comparison, editorial commentary, and shopping navigation. Mentioning or displaying a brand does not imply sponsorship, authorization, partnership, or endorsement.
Product imagery may belong to brands, retailers, photographers, marketplaces, or licensors. WOTS does not claim ownership over third-party product images. Product representations in AI generations may not be exact, and users receive no trademark or product-image rights through WOTS.
9. Service Availability and Changes
WOTS may change, pause, limit, or discontinue features, pages, subscriptions, AI generation, content, or links. We do not guarantee uninterrupted operation, generation completion time, content accuracy, product availability, merchant availability, or that saved content will remain available indefinitely.
10. Warranties, Liability, and Indemnity
WOTS is provided on an "as is" and "as available" basis to the extent permitted by law. We do not guarantee the accuracy of outfit identifications, product details, sizing, prices, availability, merchants, images, AI outputs, or editorial content.
To the extent permitted by law, WOTS and its officers, directors, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, lost data, merchant disputes, failed AI generations, or third-party conduct.
You are responsible for your uploads and use of WOTS. To the extent permitted by law, you agree to defend and indemnify WOTS from claims arising from your violation of these Terms, unlawful uploads, misuse of AI Fit Pics, infringement of third-party rights, or misuse of merchant links. Some consumer rights cannot legally be waived, and nothing in these Terms limits rights that cannot be limited under applicable law.
11. Rights Complaints
WOTS may remove, replace, crop, restrict, disable, or review images, product data, links, AI references, or editorial content following a valid complaint or internal risk review. See the Copyright and Rights Policy for complaint instructions.
